These Terms & Conditions (“Terms”) govern your access to and use of ProtoHyped, operated by ProtoHyped (“we”, “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
The Service
ProtoHyped lets you create realistic landing pages for product ideas, publish them, and measure visitor behavior in order to gauge demand. We may change, suspend, or discontinue any part of the Service at any time.
Accounts
You must provide accurate information when registering and keep your credentials secure. Authentication is handled by our provider (Clerk). You are responsible for all activity under your account, and you must be at least 16 years old (or the age of digital consent in your country) to use the Service.
Acceptable use
- Do not use the Service to publish unlawful, deceptive, infringing, or harmful content, or to impersonate a real product or business you are not authorized to represent.
- Do not misuse the Service, including by attempting to interfere with its security, generate fraudulent traffic or leads, or access data that is not yours.
- You are responsible for complying with all laws applicable to the landing pages you publish, including consumer-protection, advertising, and privacy laws, and for honoring any commitments you make to people who submit their details.
Your content
You retain ownership of the ideas, copy, and other materials you submit (“Your Content”). You grant us a worldwide, non-exclusive license to host, process, and display Your Content solely to operate and provide the Service. You represent that you have the rights necessary to submit Your Content and that it does not violate these Terms.
Subscriptions and billing
Some features require a paid subscription. Pricing, billing cycles, renewals, taxes, and refund terms are presented to you at checkout before you confirm. Unless stated otherwise, subscriptions renew automatically until cancelled, and fees already paid are non-refundable except where required by law. We may change pricing on notice for future billing periods.
Intellectual property
The Service itself, including its software, design, and trademarks, is owned by ProtoHyped and its licensors. Except for the rights expressly granted to you, we reserve all rights in the Service.
Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any metrics or predictions it produces are accurate or will lead to any particular outcome.
Limitation of liability
To the fullest extent permitted by law, ProtoHyped will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill. Our total liability arising out of or relating to the Service will not exceed the greater of the amounts you paid us in the twelve months before the claim or USD 100.
Indemnification
You agree to indemnify and hold ProtoHyped harmless from any claims, damages, and expenses (including reasonable legal fees) arising from Your Content, your use of the Service, or your breach of these Terms.
Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or to protect the Service. Provisions that by their nature should survive termination will survive.
Governing law
These Terms are governed by the laws of the jurisdiction in which ProtoHyped is established, and the courts of that jurisdiction will have exclusive jurisdiction over any dispute, without regard to conflict-of-laws rules.
Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above, and continued use of the Service after changes take effect constitutes acceptance.
